I.- Users
The access and/or use of Enermes Web site attributes to the maker the user condition, accepting, from that moment, completely and without bookings, the present general conditions, thus so the particular conditions which, on its case, complement, modify or substitute the general conditions in relation with determined services and contents of the Web site.
II.- Web site use, its services and contents
The user is compromised to use the Web page and its services and contents without infringe the current legislation, good will, generally accepted use and public order.
Therefore, it is prohibited; the use of the Web for illicit purposes against Enermes, S.L. or a third party, or that in some way might avoid the good working characteristics of the Web site.
- Respect to the contents (information, texts, graphs, sound files and/or images, pictures, designs, etc.), it is forbidden:
- Its reproduction, distribution or modification, unless it is legally allowed or you count with the authorization of the legitimate entitle.
- Any violation of Enermes, S.L. rights or the rights of the legitimated entitled persons.
- Its usage for all kind of commercial and marketing purposes, different of the strictly allowed ones.
- Any try to obtain the Web sites contents by any method different to the ones at the disposition of the user, as well as those normally employed in the net, whenever do not cause damages to Enermes, S.L. Web site
III.- Unilateral modification
Enermes, S.L. could modify. Unilaterally and without previous warning, whenever its considers opportune, the structure and design of the Web site, as well as modify or eliminate, the services, the contents and access conditions and/or Web site use.
IV.- Hiperlinks
The establishment of any “Hiperlink” between a Web page and any Web pages of Enermes', S.L. Web site will be subjected to the following conditions:
- It is not allowed total or partial reproduction of none of the services either of the contents of Enermes, S.L. Web site.
- Deep-links will not be established with the Web pages of the Web site either of its services either a browser or border environment will be created.
- The Web page on which the Web hiperlink is established will not have any branch, commercial name, establishment heading, denomination, logo, slogan or other distinctive signs belonging to Enermes, S.L.
- Under none circumstance Enermes, S.L. will be responsible of the contents or services offered to the public on the Web page from which the Hiperlink is carried out both the information and demonstrations included.
V. Guaranties and responsabilities exclusion
Enermes, S.L. does not grant any guaranty either makes responsible, in none case, of the damages of any nature that could bring cause of:
- The lack of availability, maintenance and effective working of the Web and /or its services and contents.
- The lack of utility, adequacy or validity of the Web and/or of its services or contents to satisfy necessities, activities or certain results or expectative of the users.
- The existence of virus’, malicious programs in the contents.
- The reception, obtention, storage, diffusion or transmission from users of the contents
- The illicit use, negligent, fraudulent, against current general conditions, to the good will, to the usages generally accepted, or to the public order, of the Web site, its services or contents, from users hands.
- The lack of licit, quality, trustworthiness, utility, availability of the services provided by third parties and to the disposal of the Web site users.
- The non – fulfilment by third parties of their obligations or compromises in relation to the services offered to the users trough the Web site.
VI. Duration
The duration of the Web site services is undefined.
Without detrimenant to the previously exposed, Enermes, S.L. reserves the rights to interrupt, suspend or finish Web service prestation or any of the services which integrate it, in the same terms collected in the third condition.
VII. Intelectual Propertyl
To the effects of preserve the possible intellectual properties rights, in case of any user or a third party considers that it has been produced a violation of its legitimate rights by the introduction of a specific document in the Web, should notify this circumstance to Enermes, S.L. indicating:
- Personal details of interested titular of the presently infringed rights. If the complaint is presented by a third party, it should indicate the representation on which acts.
- Indication of the protected contents by the intellectual property rights and its place in the Web.
- Accreditation of the named intellectual property rights.
- Express declaration in which the interested is responsible of the veracity of the facilitated information in the notification.
Enermes Brand and its corresponding graphic brands are all registered brands and it is prohibited its reproduction without the authorization of the entitled person.
The legitimacy of intellectual property rights or corresponding industrials to the supplied contents by third parties is their exclusive responsibility.
VIII. Applicable Legislation & Jurisdiction
The present general conditions are ruled by Spanish Legislation
Enermes, S.L. and the user, with expressed resignation to any other privilege which could correspond them, are subjected to the jurisdiction of the courts of users home to any questions that could be caused or actions derivatives of the Web service offered and its services and contents and about interpretation, application, fulfilment or no fulfilment of the established here. In the supposition that the user lives outside Spain, Enermes, S.L. and the user, with express resignation to any other privilege which corresponds them, are subjected to Malaga’s court jurisdiction.
